HOA unauthorized condo entries

Owners of a few Mountain-Side condos have discovered that PCLMM Inc. dba Mountain Managers employees have entered units while their occupants were out for the day and searched the premises without any authorization or notification. This was first discovered in August of 2011 when guests reported to a vacation rental company that a PCLMM Inc. dba Mountain Managers employee entered a condo they had rented during their absence.  When questioned, Mountain Side Condominium Association (Colorado HOA 24048) representatives acknowledged that they have indeed entered condos in the past without notifying owners and without a documented emergency. These activities are against the rules and regulations (not to mention the law) established by the Mountain Side Condominium Association HOA 24048, which stipulates that the HOA has the right to enter a condo without permission only in a case of an emergency.

In December of 2012, PCLMM Inc. dba Mountain Managers notified all owners that they were going to enter all units and conduct a new search. This was not in response to an emergency and therefore required the owner’s consent prior to entering each unit. The PCLMM Inc. dba Mountain Managers entered their understanding of the regulation into the record during the Mountain Side Condominium Association HOA 24048 Board of Directors meeting minutes. Subsequently,  30+ owners expressly denied them access to their units. PCLMM Inc. dba Mountain Managers employees disregarded these verbal and written notices and proceeded to enter the units that they knew were unoccupied.  Mountain Managers, Inc. employees then monitored occupied units and waited for the occupants to leave and immediately entered when they saw the occupants leave for the day.

This has prompted several owners to file police reports for trespassing and illegal entry (cf. illegal entry into D-317, E279 and G-206) against the Mountain Side Condominium Association HOA-24048 Board of Directors and PCLMM Inc. dba Mountain Managers.     This another example of the heavy handed approach to supposed rule enforcement by the MountainSide HOA and Mountain Managers, Inc..

    EXCEPT IN THIS CASE IT’S NOT JUST POOR RECORD KEEPING, FAILURE TO RESEARCH THE FACTS AND OVERSTEPPING AUTHORITY AFTER BEING QUESTIONED BUT RATHER:

    1.) Neither the HOA BOD’s nor PCLMM Inc. dba Mountain Managers ever contacted me (the owner of three units) to ask what was in my units. I guess it just never occurred to our Board or PCLMM Inc. dba Mountain Managers to communicate with me as an adult owner of three Mountain Side units rather than simply disregard my rights as the owner and enter my units illegally. In other words, given two options, both our HOA Board of Directors and PCLMM Inc. dba Mountain Managers consciously chose to enter my units illegally and in total disregard of my written direction not to, over calling or writing me to ask what’s in the units. In fact, they never even tried! Their decision to choose wrong over right and their subsequent actions are very disturbing. Normal, reputable and functional people, associations and businesses just don’t work that way. At least not in my experience.

    2.) PCLMM Inc. dba Mountain Managers, their owners, employees and agents do NOT own my condominium units into which they chose to illegally enter.

    3.) The MountainSide HOA-24048, its directors, officers and agents do NOT own my condominium units into which they directed Mountain Managers, Inc. to illegally enter.

    4.) PCLMM Inc. dba Mountain Managers, the MountainSide HOA-24048 BOD, their directors, officers employees and agents have apparently forgotten or simply choose to ignore the fact that they work for the individual owners to whom they owe a legal and fiduciary duty and do not have the authority to break, enter and freely wander their property(ies) without authority or permission except under very specific emergency situations as defined in the HOA rules. Neither of the two aforementioned reasons for doing so is acceptable, normal, reasonable or…..legal.

    As I also indicated in my comments under Washers and Dryers on the this site, this type of heavy handed and nefarious activity on the part of the HOA-24048 BOD’s and its Managers has to stop.
